Intro to WND’s ‘After Farah Suffers Stroke…’

The online publication WND has been around a long time founded in 1997. WND’s own press asserts it is the oldest online publication of its kind.


With that said, I’m on the WND email alert list providing timely news articles. This is how I discovered the unfortunate news the WND founder Joseph Farah has suffered a stroke. Below are some brief details posted on WND 3/28/19:

Recently, adversity hit hard when our company’s founder and CEO, Joseph Farah, suffered a serious stroke. After spending several days in the hospital undergoing extensive testing and evaluation, he is now home, resting comfortably and recovering.

Although no one can say with certainty how long he will be away from WND, what I can say with certainty is that Joseph and his family are extremely appreciative of your prayers, as are all of us at WND.

Joseph’s medical crisis, in addition to being a difficult trial for the Farah family, is likewise tough for those of us staffing the news organization he founded and has led for 22 years. I’ve known Joseph Farah for three decades, and for 20 years have worked closely with this pioneering journalist as a colleague, good friend and fellow Christian. I know him as a man of enormous talents, integrity and genuine faith.

For me, even more disturbing, the formerly great Washington Post recently published a hit piece against WND mere days after Farah’s stroke was announced. It’s a sad day in the media industry when a media giant rips into another media company whose founder has had a severe medical event.

But I guess I shouldn’t be too surprised since WaPo has become one of the chief purveyors of Left-Wing Fake News.

David Kupelian writing for WND chastises WaPo and provides reassurances about WND’s intentions to keep providing Conservative news with a Christian and pro-Israel slant.

AFTER FARAH SUFFERS STROKE, WASHINGTON POST LAUNCHES MAJOR ATTACK ON WND
America's 1st online journalism organization responds to attempted takedown by D.C. behemoth

Just five days after WND went public with the news that its founder, editor and CEO, veteran journalist Joseph Farah had suffered a devastating stroke, the Washington Post has published a lengthy article attacking Farah, his wife Elizabeth, and WND, America’s first online journalism organization.

The story, sensationally headlined “Inside the spectacular fall of the granddaddy of right-wing conspiracy sites,” cites mostly unnamed former employees and others. The Post also mysteriously managed to get a hold of the contents of WND’s private email server, referencing and picking apart numerous internal emails going as far back as 12 years.

So, what does the Washington Post story actually allege?

Against a backdrop of ongoing financial struggles at the company, the article rolls out numerous examples of unpaid bills, unhappy authors, supposedly bad judgment, failure to adequately communicate with board members, and “reckless and undisciplined” spending by the company’s founders.

Evidently the Post considers it shocking and newsworthy that over its 22-year history, a small, influential though undercapitalized company in a highly competitive business, rocked regularly by seismic changes – the dot-com crash, the Google-Facebook-Amazon disruption of the internet and so on – might experience its share of failures, difficulties and embarrassments.

Nowhere in the Post’s article is anything remotely illegal alleged. More to the point, nor does the Post acknowledge the important and highly regarded reporting generated day in and day out, year after year, by WND’s journalists – most of whom, remarkably, have been with WND for virtually all of its two decades of existence.

Most interestingly, nowhere in his massive 2,700-word article does Post reporter Manuel Roig-Franzia ever get down to what has actually caused the precipitous drop in annual revenue at WND over the last couple of years, which has led to the company’s current struggles.

Irony alert: One of WND’s most critical revenue streams over the past two decades has been its robust e-commerce operation featuring thousands of products: the WND Superstore. But WND’s store revenues have dropped dramatically, just as sales have tanked at countless other retailers both online and brick-and-mortar, from Barnes & Noble to Macy’s, thanks to one company – Amazon – whose founder, CEO and president Jeff Bezos is the owner of the Washington Post, having purchased it in 2013 for $250 million.

Seeing as Bezos is the world’s wealthiest human being, the Post fortunately suffers no financial problems like WND and others do.

But there’s more: Besides Amazon, other internet mega-monopolies including Google and Facebook have all but destroyed the other major revenue stream for online news: advertising.
“Journalism, sustained by traditional advertising, is dying,” says the respected Washington, D.C.-based Electronic Privacy Information Center, whose written testimony to Congress’s Subcommittee on Digital Commerce & Consumer Protection explained starkly that “the revenue model that sustained journalism is broken.”

These developments on the internet – along with the now well-documented progressive-left bias, censorship, skewed search algorithms, demonetizing, shadow-banning, outright banning and multiple other modes of suppressing non-leftwing thought – have severely impacted many independent journalism organizations, including WND.

There is so much in the Post’s article that is unfair, misleading and just wrong. But rather than refute every allegation and innuendo in this one-sided, unsympathetic portrayal of a vastly smaller but influential news competitor, maybe it’s fair game – since the Post casts aspersions not just on the actions, but the motivations, of WND co-founders Joseph and Elizabeth Farah – to examine the Post’s own motivations and agenda.

The Washington Post was once a great newspaper (I grew up in Washington and the Post was delivered to our door daily), best known for its fabled Watergate coverage, with Woodward and Bernstein inspiring a generation of young people to follow in their journalistic footsteps – including Joseph Farah. Those days are long gone. Critics today refer to the Washington Post as “Jeff Bezos’ vanity paper,” the Amazon founder’s chief lobbying-propaganda arm in the nation’s capital.

For the past two-plus years, the Post has been in the forefront of the fake news coverage of the phony Trump-Russia-collusion hoax. Let’s be clear: Month after month after month, the Washington Post feverishly promoted the worst hoax in American history.

Even before Trump’s election and the Russia hysteria, the Post frequently compared the New York businessman to Adolf Hitler. That’s right. As this writer documented in 2016, during that historic year the Washington Post’s election coverage included no fewer than five different Post writers explicitly comparing Trump to the Nazi monster who murdered 11 million people.

Enough said. As Tucker Carlson puts it, “The Washington Post is not a serious newspaper. It’s a joke.”

Although Joseph Farah is the only person situated to respond to many of the Post’s allegations, the paper chose to publish its takedown article right after Farah suffered a major stroke rendering him totally unable to defend himself, his wife and his news organization.

I don’t know why the Post chose to do such a thing. But I’ll close by simply saying for the record, as WND’s vice president and managing editor for 20 years, that I have nothing but the highest respect and love for this amazing news organization, for its founders Joseph and Elizabeth Farah, and for the dedicated journalists who work here.

Finally, regarding that Post headline gloating over “the spectacular fall” of WND: To paraphrase Mark Twain, “Reports of our death have been greatly exaggerated.” WND is still here. And we’re committed to doing what we’ve been doing since before Amazon, Google, Facebook and others even existed – to boldly report without fear or favor on all the corruption, lies, fraud, abuse, attacks on the Constitution, and outright delusions that increasingly dominate our great country. As the 2020 election nears, count on us to focus on underreported but life-and-death issues like voter fraud in all its forms, the left’s disastrous and flat-out insane agenda, Big Tech’s intended election rigging and much more – oh yes, and exposing fake news.

SMOKING GUN MEMO LAID OUT LEFT’S ASSAULT ON CONSERVATIVES
While President Trump was being inaugurated, the Soros-funded Left was busy agitating.

A strategy memo compiled by George Soros-funded activist groups as President Trump was being inaugurated last year foretold and seemed to lay the groundwork for many of the political difficulties Trump now faces and the politics-related strife now roiling the nation.

The memo takes on a heightened importance as the politically-driven censorship of conservatives by the gigantic, unregulated social media corporations controlled by the Left is moving into high gear while the crucial midterm congressional elections of Nov. 6 approach.

The intensely anti-conservative animus in the memo may have inspired MasterCard and WorldPay’s attempt on Aug. 21 to strangle the fundraising efforts of the David Horowitz Freedom Center, publisher of FrontPage, by refusing to complete its financial transactions. On that day MasterCard informed the Freedom Center that it would no longer process its transactions because it had been labeled a “hate group” by the radical leftist groups known as the Southern Poverty Law Center and ColorOfChange.org. The Freedom Center stood falsely accused of being “hateful in nature” and “advocating for violence.”

Only a massive outcry by conservative groups and prominent conservatives like Rush Limbaugh forced MasterCard to back down days later and restore the Freedom Center’s online fundraising facilities. But other conservative websites haven’t been so lucky. Many have been shut down or seen their traffic slashed as leftists have manipulated algorithms and limited the reach of conservative content.

The David Horowitz Freedom Center has since called for a coalition to be created across partisan and ideological lines to defend free speech.

The memo itself, "Democracy Matters: Strategic Plan for Action," marked an escalation in tactics by the Left. It was first made public last year by Joe Schoffstall of the Washington Free Beacon around the time Donald Trump took the oath of office to become the nation’s 45th president. This smoking-gun planning document aimed at suppressing conservative voices on social media was ignored by the mainstream media at the time and in the more than a year-and-a-half since.

The document spelled out the Left’s plans for impeaching President Trump, filing lawsuits against the fledgling administration, and using social media to delegitimize Trump’s presidency and hurt Republicans. “Right now, our institutions are among the critical few that stand between the America we love and the abyss,” the memo stated. “We must protect and defend our democratic values. We will not back down. We will only move forward.”

WND founder Joseph Farah referred last week to the 49-page memo as a blueprint “revealing how George Soros operatives, including David Brock, were there at the genesis, the planning stages, with their hands on the ignition key, of the most concerted, well-funded, diabolical attack on free speech in the history of America.”

The document “was nothing short of a plan to turn Google, Facebook and other social media into hyper-partisan Democratic Party activists, promoters, cheerleaders, and off-the-books donors in an effort to turn the country into a one-party state.”

The memo outlined left-wing activist David Brock's four-year plan to undermine the Trump administration and Republicans using Media Matters for America (MMfA), American Bridge 21st Century, Citizens for Responsibility and Ethics in Washington (CREW), and left-wing propaganda website Shareblue. All four organizations were either founded by Brock or are now controlled by him. Since 2008, leftist billionaire George Soros has given more than $1.5 million to MMfA and more than $1.1 million to CREW through his philanthropies.

Brock, who reportedly raised $65 million during the 2016 election cycle, began working on his plan more or less immediately after Republican Donald Trump unexpectedly trounced Democrat Hillary Clinton in the presidential election in November 2016.

Brock and his comrades met in Palm Beach, Fla., as Trump assumed the presidency and Trump-hating Antifa rioted in the streets of the nation’s capital. “What better way to spend inaugural weekend than talking about how to kick Donald Trump’s ass?” Brock said in an email to left-wing mega-donors including Soros and Tom Steyer.

Whether Brock can take responsibility for all the leftist-inspired turmoil in the country is debatable, but many of the goals identified in the memo have already come to pass.

According to the memo, MMfA “will continue its core mission of disarming right-wing information.” This is what “success will look like,” the document states:

Serial misinformers and right-wing propagandists inhabiting everything from social media to the highest levels of government will be exposed, discredited.

Internet and social media platforms, like Google and Facebook, will no longer uncritically and without consequence host and enrich fake news sites and propagandists.

Toxic alt-right social media-fueled harassment campaigns that silence dissent and poison our national discourse will be punished and halted.

CREW will become “the leading nonpartisan ethics watchdog group in a period of crisis with a president and administration that present possible conflicts of interest and ethical problems on an unprecedented scale,” the memo states.

CREW “will demand ethical conduct from the administration and all parts of government, expose improper influence from powerful interests, and ensure accountability when the administration and others shirk ethical standards, rules, and laws.”

Success will take this form, according to the document:

Trump will be afflicted by a steady flow of damaging information, new revelations, and an inability to avoid conflicts issues.

The Trump administration will be forced to defend illegal conduct in court.

Powerful industries and interest groups will see their influence wane.

Dark money will be a political liability in key states.

The Shareblue website “will take back social media for Democrats,” the memo states. The group will “delegitimize Donald Trump's presidency by emboldening the opposition and empowering the majority of Americans who oppose him.”

Success will be achieved when the following happens:

Shareblue will become the de facto news outlet for opposition leaders and the grassroots.

Trump allies will be forced to step down or change course due to news pushed by Shareblue.

Under pressure from Shareblue, Democrats will take more aggressive positions against Trump.

Shareblue will achieve financial sustainability while diversifying content offerings and platforms.

Top editorial and writing talent will leave competitors to join Shareblue.

Meanwhile, President Trump told reporters in the Oval Office on Tuesday that social media giants Google, Twitter, and Facebook “better be careful” because they “are treading on very, very troubled territory” by favoring left-wing viewpoints.

Earlier that day he tweeted, “This is a very serious situation—will be addressed!”

“Google search results for ‘Trump News’ shows only the viewing/reporting of Fake New Media. In other words, they have it RIGGED, for me & others, so that almost all stories & news is BAD,” he wrote. “Republican/Conservative & Fair Media is shut out. Illegal.”

Google CEO Sundar Pichai has indicated he will not testify at a Senate Intelligence Committee hearing Sept. 5. on social media and Russian meddling in American elections. Unlike Pichai, Twitter CEO Jack Dorsey and Facebook Chief Operating Officer Sheryl Sandberg are expected to testify.

Whether Dorsey and Sandberg will tell the truth is an open question.

You can't make this stuff up.

Never, even in my fertile imagination, would I have guessed that we would find a smoking-gun 49-page memo revealing how George Soros operatives, including David Brock, were there at the genesis, the planning stages, with their hands on the ignition key, of the most concerted, well-funded, diabolical attack on free speech in the history of America.

But there it is.

Millions saw it on the DrudgeReport – including, no doubt, President Trump, Vice President Pence and Republican congressional leaders. But most Americans still know nothing of its existence – because it was not reported among the Big Media. They don't want you to know about it. They would be embarrassed if America found out how they have been used and manipulated – from their focus on "Russian collusion" to other wild conspiracy theories targeting their No. 1 villain, President Trump.

It was nothing short of a plan to turn Google, Facebook and other social media into hyper-partisan Democratic Party activists, promoters, cheerleaders, and off-the-books donors in an effort to turn the country into a one-party state.

And they're getting away with it, even though the beans have been spilled publicly. That's partly because, as I have pointed out before, Google-Facebook control the media. They use the media. They manipulate the media. They choose winners and losers among the media. That's real power that we have never seen before in American life.

The timing of this insidious plot is key. When did it begin? Right after Trump was inaugurated. That's when the attacks on the independent, alternative media — WND, Breitbart, et al. — began. We've been feeling the squeeze ever since — through politically skewed algorithms and speech codes.

The Google-Facebook-YouTube-Twitter-Amazon-Apple cabal is trying to ensure that we never have a free and fair election again in America. The "Russia-collusion" hoax is meant to take your eye off the real collusion by un-American, anti-free speech radical political activists.

Do you get it now?

Do you understand what I have been warning about furiously since January of this year?

These people are crazed, shameless and hell-bent on fundamentally transforming America from a free and open society to one that is dominated by mega-corporations who want to control everything – mostly you and how you think and behave.
Now, what do we do about it?


·        Recognize the battle the Trump administration finds itself in. This plot was designed to stop him. It's as close to a coup attempt as anything devised by the Deep State rear guard. So, they devised a scheme to attack those in the independent, alternative media that helped get him elected by countering their lies. They determined to do that by killing the messengers – and they are very close to accomplishing that objective.

·        Pray that the president, the vice president and Republican congressional leaders challenge the "Speech Code Cartel" while they still can or else America will find itself in a cultural and political endgame, on the verge of tyranny.

·        Support those being hurt most right now, those fighting for survival, in the independent, alternative media with your prayers and financial support. Their traffic and revenues have been stolen from them by the powerful leftist social media cabal and their speech-code cops in the Southern Poverty Law Center.

Banning Alex Jones?

Justified Only If…

Alex Jones is literally being censored on every digital media format I can think of.

I have to be clear. I am not a supporter or big fan of Mr. Jones. Many of his Conspiracy Theories propagated from his soapbox are just plain outlandish and crazy.

The massive digital censorship Jones is accused of is hate-speech. Frankly, as outlandish and offensive Jones can be I am not surprised the hate-speech accusations are levelled against him.

I do have a couple of problems with the censorship.

ONE: The same media platforms censoring Jones allow Muslims to spew Jew-Hatred and promote physical harm to Jews and other non-Muslims. However, when a non-Muslim points out Islamic tenets and Muslim history demonstrate violent hatred for all things non-Muslim specifying Jews, Christians and polytheists. Militant homosexuals overtly express hatred toward Biblical Values Christians yet will censor Biblical Values Christians for supporting the Bible’s labelling the homosexual practice a sin against God’s Word. In essence this is censorship hypocrisy.

TWO: The same media platforms rarely if ever censor Left-Wing calls for violence against Conservatives yet they will censor Conservatives refuting a violent Leftist agenda. For example Maxine Walters advocating Leftists to disrupt reputed Conservative meetings and Conservatives living their private lives at open-to-the-public venues. Astonishingly to date, Conservative individuals have refused to respond with self-defense violence for Leftist provocation. I’m a disabled dude and I don’t know if I would exhibit such self-restraint to respond with action if someone shouting directly in front of my face.

I hate defending Alex Jones because I am convinced he has used actual hate-speech; however look at some of phrases the digital media platforms label as hate-speech worthy of censorship via banning:

The resident Jew, Leftist Jews, Jewish Mafia (Alex Jones Accused Of Anti-Semitism, Sexual Harassment; By Aiden Pink; Forward.com; 3/1/18)

The same article on Forward.com also illustrates actual forms of hate-speech via sexual harassment which is unacceptable but demonstrated on Alex Jones programs.

I don’t know what Alex Jones other than the vague accusation of the kind of speech the digital platforms call hatred or inciting violence:

“… the stated reason for the ban on his content is not defamation but “hate speech” against Muslims, transgender people, and other groups.” (Booting Alex Jones from social media wasn't wrong, but it could be dangerous; By Cathy Young; USA Today; 8/8/18 9:03 a.m. ET)

If the hate-speech was critical of a belief system corresponding to Islam or the LGBTQ agenda, then said hate-speech violation is an absurd accusation. If Jones said something dimwitted such as maybe, “hunt down the camel jockeys and give them a tasted of their own medicine” or “rope the fudge-packer and drag the shem down the road”. Those kinds of phrases are indeed inciting violence and is a good reason for censuring and/or banning.

Instead, the overt attack on America’s First Amendment comes from the corporate behemoth internet gatekeepers who are in ideological lockstep with each other – from Google to YouTube to Facebook to Twitter to Apple to Amazon.

This week, YouTube and Facebook followed Apple’s lead in banishing Alex Jones, the iconic, high-energy voice that rails against globalism and the Deep State daily on radio, podcasts and his own Infowars TV show. He was an easy target and a predictable one – a controversial figure, without doubt, and a high-profile one with a sizable following.

Not everyone wants to defend Alex Jones – certainly not everything he says.

Yet, the First Amendment wasn’t crafted by America’s founding geniuses to protect tepid, non-controversial speech. It was crafted to protect just this kind of fiery dialogue – the kind that offends some people, some sensibilities. Alex Jones is a good choice to start the censorship juggernaut rolling if you think like the Southern Poverty Law Center. And one thing Apple, Google, YouTube, Facebook, Twitter and Amazon all have in common is their love of, reverence for, and partnerships with this extremist band of smear merchants who never met anyone right of center that they didn’t label a “hater,” a “fascist,” a “Nazi” or a “racist” – including, of course, the current president of the United States.

So, first the Digital Cartel came for Alex Jones.

Who will be next? I don’t know, but I don’t plan to find myself in the position in which Martin Niemöller found himself in Nazi Germany. He’s most famous for this prescient quotation: “First they came for the Socialists, and I did not speak out – Because I was not a Socialist. Then they came for the Trade Unionists, and I did not speak out – Because I was not a Trade Unionist. Then they came for the Jews, and I did not speak out – Because I was not a Jew. Then they came for me – and there was no one left to speak for me.”

I’m going to defend Alex Jones’ right to say what he wants – even if I sometimes, or even often, find myself in disagreement with him. And I’m going to condemn this cabal of bloated mega-corporations imposing their ideology on America’s most vital public square – the digital media.

Maybe you say, “Well, Farah, don’t these corporations have the absolute right to approve and disapprove of the viewpoints they carry – just like you do?” The answer may be surprising: No, they don’t. None of these conglomerates are publishers, content producers, part of the “press.” They are more akin to “utilities” – like the telephone companies of old, or the electricity producers who have a public obligation to be fair and neutral in offering the services they provide to all, without regard to race, religion and ideology. They don’t have to like Alex Jones. They don’t have to listen to Alex Jones. But if they are going to hold these privileged positions of making lots of money by distributing all manner of content, data and information to the public, they dare not think of themselves as ideological gatekeepers against "offensive" political speech. And they better not designate the disgraced partisan hacks of the SPLC as their content cops, which is precisely what they have done – all of them!

I know I sound like a broken record on this theme, but I’m going to keep pounding on it until the public catches on to the threat these trillion-dollar monopolies pose to America’s precious institutions of free speech, the free press and freedom of religion. We need congressional hearings. We need action in Washington. We need President Trump to recognize who the biggest purveyors of fake news really are. It’s not just CNN and the Huffington Post. It’s their distribution arms – Google, YouTube, Facebook, Twitter, Apple and Amazon – the Digital Cartel.

It's time to throw down the gauntlet, draw a marker in the sand, file class-action lawsuits, summon our leaders to action.

Are we going to let this cabal render the First Amendment null and void?

I’ve been telling you how they have attacked WND relentlessly and ruthlessly through its politically and religiously discriminatory algorithms. I’ve told you how they have been coming after the independent media, especially since the 2016 election that so disappointed all of them.

Do you really want to talk about supposed Russian interference in our free society when this powerful monolithic cartel is setting the rules of debate for Americans out in plain sight – openly censoring voices they don’t like while systematically elevating those they do like? What a sick joke!

Mark Levin is on a tear and it is a wonder to behold. I just watched him provide solid proof on Fox News on how all these police tactics against President Trump did indeed occur. The media provided most of the proof themselves that the two FISA requests were sought by Obama the first one in June of last year, which mentioned Trump directly and was denied, and a second that occurred in October last year and was narrowed in scope, then was approved. It looks like it may have been targeting a server in the White House that was emailing Russian banks supposedly. No wrongdoing was found, unless of course you count what Obama did.

Levin has laid out exactly how this should be investigated and he has the full attention of the White House. His findings and recommendations have been circulated to several White House staffers, according to Washington Post reporter Robert Costa. The FISA orders and transcripts should now be made public and hearings should begin over all this. The media is still insisting there is no proof, when they provided said proof. This is insane.

Mark Levin, Conservative Review’s editor-in-chief, recommends the Trump administration open an investigation into Barack Obama. Levin states the former president’s team used police-state tactics against then-candidate Trump during the 2016 election.

“The gravity of this is unparalleled. It appears that during the course of a presidential election, the Obama administration used both intelligence and law enforcement agencies to investigate the Republican nominee’s campaign and certain surrogates,” Levin tells Conservative Review.

Levin – who served as chief of staff for President Reagan’s Attorney General Ed Meese – explained the potential scandal on his Thursday evening radio show:

“We have a prior administration – Barack Obama and his surrogates – who are supporting Hillary Clinton and her party, the Democratic Party. Who were using the intelligence activities to surveil members of the Trump campaign, and to put that information out in the public.

“The question is: Was Obama surveilling top Trump campaign officials during the election?” Levin asked on “The Mark Levin Show.”

Mark Levin is calling this a silent coup. And he is correct. I’ve looked right at this evidence for months and I never connected the dots. I’m so glad Levin did. It is obvious to me that Barack Obama did know about all this and had Lynch at the DOJ once again do his dirty work. There was and is an orchestrated plan to sabotage the Trump presidency and not only stop him from getting his appointees approved, but stop him from accomplishing anything of merit or that would hurt the Obama legacy.

A myriad of things now look very connected. The protests and riots, Valerie Jarrett moving into Obama’s mansion, Jarrett’s daughter being hired by CNN to cover the DOJ and Jeff Sessions when she’s not even a journalist, the attack on Jeff Sessions himself, and on and on and on. When do we wake up and realize we are at war within? And that Obama and his activists must be stopped and held accountable. You’ve got Loretta Lynch literally calling for blood and death in our streets: Theyve marched, theyve bled and yes, some of them died. This is hard. Every good thing is. We have done this before. After Donald Trump blew the whistle on the eavesdropping of his 2016 campaign headquarters by Barack Obama’s administration, few in the media or elsewhere seem to be asking the obvious questions:
Was it legal?

Was it ethical – in the American way?

One thing is for certain: If the roles were reversed and the Trump administration bugged Democrats, you can imagine the media would take a much different view.

Let’s first take a look at how the media reported this travesty of justice, political decorum, the Constitution and American legal tradition:

o   Washington Post: President Trump on Saturday angrily accused former President Barack Obama of orchestrating a “Nixon/Watergate” plot to tap the phones at his Trump Tower headquarters in the run-up to last fall’s election, providing no evidence to support his explosive claim and drawing a flat denial from Obama’s office.

o   CNN: Trump’s baseless wiretap claim

o   Atlantic: Trump’s Unfounded Claims of a “Nixon/Watergate” Wiretapping Scheme

o   Huffington Post: Obama Refutes Allegation that He Wiretapped Trump Tower During Campaign

o   New York Daily News: Trump’s poor understanding of national security investigations may prove dangerous

o   New York Times: President Trump on Saturday accused former President Barack Obama of tapping his phones at Trump Tower the month before the election, leveling the explosive allegation without offering any evidence.

The emphasis of all of these “fake news” reports is disingenuous to say the least. Obama didn’t deny his administration wiretapped Trump. He said no one at the White House did. That is a virtual admission that his administration did, probably Justice Department, meaning the “apolitical Loretta Lynch” who just called for “blood and death” in the streets to stop Trump, much to the approval of Senate Democrats. It’s an obvious parsing of words by the slick Obama.

The accusation is indeed bigger than Watergate, which began with an attempt not to eavesdrop directly on Richard Nixon’s opponent in the 1972 presidential election, but on Larry O’Brian, the head of the DNC, whose offices were in the Watergate Hotel. He was the Debbie Wasserman-Schultz of his day, but she and Hillary Clinton campaign Chairman John Podesta didn’t bother securing their email communications, and you could read them all on WikiLeaks.

And that brings us to the excuse for Trump’s campaign being undoubtedly bugged – the elusive evidence for Russian hacking and interference in the 2016 U.S. election.

If you doubt there is no evidence, just carefully read every New York Times story on the fake scandal. Way down near the bottom of every story, the paper that has trumpeted this story the most admits there’s no evidence.

So, here’s the way this thing obviously went down.

Obama’s team first tried to get a broad FISA warrant to investigate the Russian fantasy. The judge turned it down.

It tried again with a narrower FISA warrant request. The judge turned it down.

Then it tried a third time, and the judge approved it in October. Coincidentally, that is the exact time Trump says the wiretapping began.

Not one of these big news organizations will tell you that.

It’s the attorney general who would request such wiretap authorizations for heavy-duty, politically charged requests such as this – not that any have ever been requested or authorized in the history of the republic.

Do news organizations really want to be covering up stuff like this? Don’t they understand the same tactics can be used against them? Obama, or (wink-wink) Lynch, just set the precedent.

Nixon never did anything remotely like this – and he was forced from office as a result. Obama or Lynch could well be prosecuted by the Trump administration. And one or both probably should be.

Misuse of FISA statutes is a clear violation of the law.

FISA can only be used for “foreign intelligence information” as the basis for surveillance to protect the U.S. against a “grave” or “hostile” attack, war-like sabotage or international terror.

Does anyone suggest such a thing with regard to Russian hacks?

That’s what makes this scandal, pardon the expression, “bigger than Watergate.”

Out of more than 35,000 FISA court requests, only 12 have ever been rejected. But two out of three requested by the Obama administration to investigate the Russia deal were. What does that tell you?

It tells me this was a political fishing expedition to build a case against Trump if or when he beat Hillary.

Since the election, the hysteria over Russia’s role in the election has only increased exponentially.

And that’s why:

1)    I believe Trump.

2)    I don’t believe Obama.

3)    I don’t believe the “fake news cartel,” which is all in for finding the elusive Trump-Russia link.

What we’ve got here at first glance is a prima facie case for “bigger and worse than Watergate.”

But the Washington Post and New York Times have already signaled they won’t be investigating. They are already publishing front-page editorials that stake out a rather shrill “see-no-evil, hear-no-evil, speak-no-evil” approach.

Was it legal? No.

Was it ethical in the American political tradition? No.

Is it one of the most dangerous developments in American political history? Yes.

The Obama Camp’s Disingenuous Denials on FISA Surveillance of Trump

President Trump’s early Saturday morning tweeting has exploded to the forefront an uncovered scandal I’ve been talking about since early January (including in this weekend’s column): The fact that the Obama Justice Department and the FBI investigated associates of Donald Trump, and likely Trump himself, in the heat of the presidential campaign.

To summarize, reporting indicates that, prior to June 2016, the Obama Justice Department and FBI considered a criminal investigation of Trump associates, and perhaps Trump himself, based on concerns about connections to Russian financial institutions. Preliminary poking around indicated that there was nothing criminal involved. Rather than shut the case down, though, the Obama Justice Department converted it into a national-security investigation under the Foreign Intelligence Surveillance Act (FISA). FISA allows the government, if it gets court permission, to conduct electronic surveillance (which could include wiretapping, monitoring of e-mail, and the like) against those it alleges are “agents of a foreign power.”

FISA applications and the evidence garnered from them are classified – i.e., we would not know about any of this unless someone had leaked classified information to the media, a felony. In June, the Obama Justice Department submitted an application that apparently “named” Trump in addition to some of his associates.

As I have stressed, it is unclear whether “named” in this context indicates that Trump himself was cited as a person the Justice Department was alleging was a Russian agent whom it wanted to surveil. It could instead mean that Trump’s name was merely mentioned in an application that sought to conduct surveillance on other alleged Russian agents. President Trump’s tweets on Saturday claimed that “President Obama . . . tapp[ed] my phones[,]” which makes it more likely that Trump was targeted for surveillance, rather than merely mentioned in the application.

In any event, the FISA court reportedly turned down the Obama Justice Department’s request, which is notable: The FISA court is notoriously solicitous of government requests to conduct national-security surveillance (although, as I’ve noted over the years, the claim by many that it is a rubber-stamp is overblown).

Not taking no for an answer, the Obama Justice Department evidently returned to the FISA court in October 2016, the critical final weeks of the presidential campaign. This time, the Justice Department submitted a narrowly tailored application that did not mention Trump. The court apparently granted it, authorizing surveillance of some Trump associates.

It is unknown whether that surveillance is still underway, but the New York Times has identified – again, based on illegal leaks of classified information – at least three of its targets: Paul Manafort (the former Trump campaign chairman who was ousted in August), and two others whose connection to the Trump campaign was loose at best, Manafort’s former political-consulting business partner Roger Stone, and investor Carter Page.

The Times report (from mid-January) includes a lot of heavy breathing about potential ties between the Trump campaign and Russia; but it ultimately concedes that the government’s FISA investigation may have nothing to do with Trump, the campaign, or alleged Russian efforts to interfere in the U.S. election by hacking e-mail accounts. Trump’s tweets on Saturday prompted some interesting “denials” from the Obama camp. These can be summarized in the statement put out by Obama spokesman Kevin Lewis:

A cardinal rule of the Obama Administration was that no White House official ever interfered with any independent investigation led by the Department of Justice. As part of that practice, neither President Obama nor any White House official ever ordered surveillance on any U.S. citizen. Any suggestion otherwise is simply false.

This seems disingenuous on several levels. First, as Obama officials well know, under the FISA process, it is technically the FISA court that “orders” surveillance. And by statute, it is the Justice Department, not the White House, that represents the government in proceedings before the FISA court. So, the issue is not whether Obama or some member of his White House staff “ordered” surveillance of Trump and his associates.

The issues are (a) whether the Obama Justice Department sought such surveillance authorization from the FISA court, and (b) whether, if the Justice Department did that, the White House was aware of or complicit in the decision to do so. Personally, given the explosive and controversial nature of the surveillance request we are talking about – an application to wiretap the presidential candidate of the opposition party, and some of his associates, during the heat of the presidential campaign, based on the allegation that the candidate and his associates were acting as Russian agents – it seems to me that there is less than zero chance that could have happened without consultation between the Justice Department and the White House. Second, the business about never ordering surveillance against American citizens is nonsense. Obama had American citizens killed in drone operations. Obviously, that was not done in the U.S. or through the FISA process; it was done overseas, under the president’s commander-in-chief and statutory authority during wartime.

But the notion that Obama would never have an American subject to surveillance is absurd. Third, that brings us to a related point: FISA national-security investigations are not like criminal investigations. They are more like covert intelligence operations – which presidents personally sign off on. [Blog Editor’s bold text]

The intention is not to build a criminal case; it is to gather information about what foreign powers are up, particularly on U.S. soil. One of the points in FISA proceedings’ being classified is that they remain secret – the idea is not to prejudice an American citizen with publication of the fact that he has been subjected to surveillance even though he is not alleged to have engaged in criminal wrongdoing. Consequently, there is nothing wrong, in principle, with a president’s ordering national-security surveillance of a potential foreign agent who may be helping a foreign power threaten American security and interests.

That is one of the president’s main jobs – there would be something wrong if a president, who truly believed the nation was threatened by a foreign power, failed to take action. Prior to FISA’s enactment in 1978, courts had no formal role in the surveillance of foreign agents for national-security purposes – it was a unilateral executive-branch function. Beginning with the Carter administration during FISA’s enactment, it has been the position of presidential administrations of both parties that, despite the enactment of the FISA process, the president maintains inherent authority under Article II of the Constitution to order surveillance even in the absence of court authorization. Of course, doing so is controversial, as President Bush learned after he directed the NSA to conduct warrantless wiretapping of suspected terrorists following the 9/11 attacks. Nevertheless, we should not allow the statements of Obama spokesmen to confuse us here. The Justice Department and FBI have two missions: (a) criminal law-enforcement and (b) national security. It would be scandalous (though probably not constitutional unconstitutional) for a president to interfere in the law-enforcement mission by ordering the Justice Department to prosecute someone outside its normal procedures.

But it would not be inappropriate  e–ven though civil libertarians would raise holy hell — for the president to direct warrantless surveillance against a target, even an American citizen, if the president truly believed that target was functioning as an agent of a foreign power threatening U.S. interests. To be clear, there does not seem to be any evidence, at least that I know of, to suggest that any surveillance or requests to conduct surveillance against then-candidate Donald Trump was done outside the FISA process.

Nevertheless, whether done inside or outside the FISA process, it would be a scandal of Watergate dimension if a presidential administration sought to conduct, or did conduct, national-security surveillance against the presidential candidate of the opposition party. Unless there was some powerful evidence that the candidate was actually acting as an agent of a foreign power, such activity would amount to a pretextual use of national-security power for political purposes. That is the kind of abuse that led to Richard Nixon’s resignation in lieu of impeachment. [Blog Editor’s bold text]

Moreover, it cannot be glossed over that, at the very time it appears the Obama Justice Department was seeking to surveil Trump and/or his associates on the pretext that they were Russian agents, the Obama Justice Department was also actively undermining and ultimately closing without charges the criminal investigation of Hillary Clinton despite significant evidence of felony misconduct that threatened national security.
