Intro to Culper’s ‘Imminent Second USA American Civil War’

Samuel Culper [bio in Forward Observer Mission Statement] has made three videos about an “Imminent Second USA American Civil War”. Culper’s videos originate on his blog the Forward Observer. However, I discovered via email alerts from Conservative, Right Wing News. And so the CRWN route is how I’m going to proceed in this cross post.

In the first video Culper asserts that civil war is in operation – NOW. He points out this civil war has not broken into conventional warfare, BUT the American Left is engaging the Right with misinformation, lies, calling ALL Conservatives extremists to brainwash the everyday American, destroy freedom, use lawfare strategies to bankrupt Conservatives and so on. The Leftist aim is to win the war without going to war.

The first video is about Leftist strategies. The second video is an attempt explain the Conservative response to Leftist strategies with the assumption Conservatives will NEVER control the government or perhaps never as long as the current bureaucracy is dominated by the Left. Culper believes the Conservative response will be regional in a balkanized scenario. Culper divides the balkanization into three scenarios:

·       Secessionist

·       Separatist

·       Resistance

I am uncertain if Culper views these scenarios evolving progressively or in sporadic simultaneous movements across the nation.

The third video is predictive in nature but with the caveat there is no certainty in predictions. Culper uses Sir John Glubb’s book on “The Fate of Empires” as the predictive paradigm. Culper views America’s westward expansion as empire building and so there is an American Empire. My personal objection to the concept of empire by conquest is at least since 1865, the USA was involved in foreign wars by conquest was never the objective. The Spanish American War resulted in territorial acquisition but when the people in those acquisitions chose self-determination, independence was granted without conflict. Cuba and the Philippines come to mind. Puerto Rico has been offered independence or statehood several times, but to date Puerto Rican voters have opted to remain a U.S. Territory.

The point Culper makes about the USA is its time as a world power has an expiration date. The allusion is the American Left/Right conflict that may deteriorate into balkanized conflict will be the demise of the America as we know it.

Trust me, I have done little justices to Culper’s envisioning of a Second American Civil War. You should watch to form your own opinion. Also the third video ends somewhat open ended with the implication Culper has more to add on the subject on future short talk videos.

Even after seven years of writing macroeconomic analysis for the liberty movement and bearing witness to astonishing displays of financial and political stupidity by more “skeptics” than I can count, it never ceases to amaze me the amount of blind faith average Americans place in the strength of the U.S. dollar. Bank bailouts, mortgage company bailouts, Treasury bond bailouts, stock market bailouts, bailouts of foreign institutions: None of this seems to phase the gibbering bobbleheaded followers of the Federal Reserve cult.  Logic and reason and wisdom bounce like whiffle balls off their thick skulls. They simply parrot one of two painfully predictable arguments:

 

o   Argument No. 1: There is no way foreign countries will ever dump the U.S. dollar because they are so dependent on American consumers to buy their export goods.

 

o   Argument No. 2: There is no way the dollar’s value will ever collapse because it is the dominant petro-currency, and the entire world needs dollars to purchase oil.

Today’s AM fix was USD 1,365.75, EUR 1,020.28 and GBP 871.29 per ounce.
Yesterday’s AM fix was USD 1,375.25, EUR 1,031.39 and GBP 878.47 per ounce.

Gold fell $6.40 or 0.47% yesterday, closing at $1,366.60/oz. Silver edged down $0.02 or nearly 0.09%, closing at $23.16. Platinum fell $14.52 or 1% to $1,504.49/oz, while palladium was down $10.75 or 1.4% to $749.75/oz.

Gold and silver both pulled back yesterday on profit taking and as stop loss limits triggered selling. There were jitters among some market participants as President Obama met the heads of the CFTC, SEC, CFPB, FHFA, NCUA, FDIC, the Comptroller of the Currency and the Federal Reserve.

Liquidated ETF gold holdings are being shipped from the U.K to Switzerland for refining into smaller one kilogramme gold bars, Australian bank Macquarie wrote in a note yesterday. These were then sent to Asia and bought by Asian investors. The note confirmed, what has been known anecdotally for some weeks.

This is contributing to the increased tightness in the physical market as large London Good Delivery bars (400 oz) are air freighted to Switzerland for refining into smaller kilo bars (32.15 ounces) for the voracious Asian market.

There is also an increasing preference for allocated storage in Switzerland by high net worths and family offices. Switzerland still has much of the world’s gold refining capacity and remains a favourite destination of investors and savers concerned about sovereign risk - including sovereign risk in the EU, U.K. and U.S.

Most of the gold ETFs holdings were held in London vaults, and U.K. gold ‘exports’ to Switzerland exploded from 92 tonnes in all of 2012 to a whopping 240 tonnes in May this year alone and a very large 797 tonnes in the first six months of 2013.

 

The 797 tonnes of gold “exported” from the U.K. to Switzerland is nearly 30% of total annual gold mining supply.

 

Investors appear to be switching from ETFs to allocated accounts, which are often held in Switzerland, Bloomberg noted. GoldCore have direct experience of this as we have seen flows from clients liquidating ETFs in the U.K., the U.S. and even Switzerland into the safety of allocated bullion accounts in Zurich and Hong Kong.

“Bail-ins” and the risk of being an unsecured creditor of investment and savings providers is one of the reasons for the flight to allocated gold.

 

Prudent and risk conscious gold investors and store of wealth buyers continue to focus on ‘return of capital’ rather than ‘return on capital’ and are therefore switching from the more high risk, in terms of counter party risk, ETFs to the safety of allocated bullion.

Store of wealth bullion buyers will use weakness to accumulate physical again due to the strong fundamentals

Has President Obama become Monte Hall in the Game Show "Let’s Make a Deal" making promises with items behind doors to the future which he cannot guarantee without a solid economic growth? Something the President promised is on the right path but just needs more time and has offered hope for a Consolation Prize called Stimulus Debt these past 4 years. And now has the American people Hooked on the handout prizes instead of growing and expanding the supply-side economy to grow tax revenues?

You can see how some of the States have been players of the Game Show rather than debating why we are not expanding the supply-side economy to grow tax revenues ….

In a World of International Trade, it’s not what paper you use to settle the transaction that’s starting to take shape, and this makes the USA vulnerable to a Currency crisis the likes never seen before!!!

Here the list of countries in here trading with each other away from the dollar, plus the amount of capital the USA is playing with itself compared to the other countries. The amounts is what I saw as a Ominous sign regarding how this article sized up the amount of dollars that are washing around the world and are finding less and less interest for ….. Notice how China is dividing the EURO Zone away from trading with the dollar between them, Germany is bailing out the PIIGS [SlantRight Editor: Portugal, Italy, Ireland, Greece and Spain Eurozone], and together they are breaking the alliance the USA has had with the European Union since the End of WW2 and the agreement of the dollar’s Reserve Currency status. The goal of taking the USA from within is reaching its proxy.

Conversation on Fiscal Cliff Mess

I wanted to pass this along to further the conversation on fixing the Fiscal Cliff mess.

 

The Fact that Developed Nations were keeping their GDPs elevated With Credit extensions to the private sector for decades up to the 2008 financial crash above the Undeveloped Nations which have been the center piece in Overall World economic growth is now being funded solely with World Government Credit. That is the New Financial Bubble we are calling the Fiscal Cliff, right?

So without Credit in the private sector as before we are watching the Federal Reserve and other Central banking sectors extend credit to Unsustainable Government spending policies and this is doing nothing to Boost Private sector GDP where we need True Revenue growth to come from, Right?

So without a Private sector credit we are devaluing in the Private sector Labor pool’s wages in the developed nations towards the undeveloped nations' Labor wage levels. This will POP the Developed Nations Government Debt Bubbles that are building, unless we level the Tax rates between the Developed and Undeveloped Nations, right?

The power in this Fiscal Cliff Negotiation is in how you want to use Foreign Aid and how this will RESINATE in the Minds of the American People. And how you can make President Obama come to the Table over how these Foreign Aid packages can either be a Higher Tax on Businesses that also contributes to these Foreign Aid Packages with Direct Business Relationships. Or having to go through the Obama Tax the Rich idea that He then wants to redistribute wealth His way!!!

This is where you can bring to the American People this case of: Do we want to trust Obama to redistribute this Foreign Aid or do we restructure the Tax code so that Businesses can Use these dollars to build within their States using this Capital as a Competitive Business that Includes Direct Business relations ships in Foreign Countries? Populism and Progressivism as Constitutional Categories

I. INTRODUCTION: CHANNEL SURFING USA

It's been a tough day. I've spent most of it worrying about the Free Speech Principle. Or at least, the Free Speech Principle described in Cass Sunstein's Democracy and the Problem of Free Speech,⁽¹⁾ a book by an author I greatly admire. According to Sunstein, the primary purpose behind free speech is promoting democratic deliberation about issues of public policy.⁽²⁾ Hence he divides speech into higher and lower tiers of protection. Speech most worthy of government protection is concerned with deliberation about public issues; the rest is subject to varying degrees of government regulation.⁽³⁾ It is a thesis with a considerable historical pedigree. Alexander Meiklejohn made a similar claim in the 1940's.⁽⁴⁾ Moreover, like Meiklejohn, Sunstein emphasizes that the scope of individual rights should consciously be shaped in order to promote the goals of democratic deliberation. Conversely, we should be less concerned about regulation of other types of speech -- for example, advertising and pornography -- because they do not contribute to democratic deliberation.⁽⁵⁾

II. THE PROBLEM OF DEMOCRATIC CULTURE

Sunstein's book is an attempt at a new liberal synthesis of First Amendment theory; in particular, he attempts to reconcile the traditional left-liberal defenses of free speech with contemporary problems of campaign finance, mass media regulation, advertising power, pornography, and racist speech.⁽¹⁹⁾ His focus on these problems is not accidental. It reflects the increasing sense among liberals that libertarian solutions in these areas have become unacceptable -- an example of a more general phenomenon I call the "ideological drift" of the free speech principle.⁽²⁰⁾ It is a tribute to Sunstein's ingenuity that he succeeds as well as he does in his task of reconciliation. Yet in so doing, he exposes a crucial fault line in theories of free speech and constitutional law generally -- a fault line organized around the meaning and value of popular culture.

Although Sunstein calls his book Democracy and the Problem of Free Speech, it could with equal justification have been called "Free Speech and the Problem of Democratic Culture." The "Problem" that concerns him is nothing less than the accelerating degradation of public culture -- a degradation both in the character of the public's viewing choices and the quality of public discourse generally.⁽²¹⁾ This concern motivates and shapes Sunstein's attempts at reconciling liberal demands for greater regulation with traditional liberal defenses of freedom of speech. He harmonizes the two by appealing to an ideal of rational public discourse. The task of law, he believes, is to approach this ideal through wise regulation. Yet this ideal of rational discourse is necessarily posed against existing popular attitudes and preferences; hence it necessarily involves a comparison in which the latter are judged and found wanting.

Of all of the many interesting issues in Sunstein's book, this theme is the most pervasive and the most important. And his crusade to mold public culture nearer to this ideal raises a large if largely obscured issue: What attitude should constitutional theorists take towards the beliefs and attitudes of ordinary citizens and the products of popular culture? I say "constitutional theorist," and not "constitutional theory," for theory is not a bloodless matrix of ideas but a practice of individuals and groups. Theory is always performed by a subject situated within a social setting and within a tradition of practice; it is the product of a subject who brings her subjectivity to an object, and pronounces judgment upon it. Hence the question I ask about the nature of popular culture is equally a question about the nature of the legal academic and her attitudes as an academic towards this culture.⁽²²⁾ Sunstein does not pose the question in these terms; yet his book has a distinctive attitude about popular will and popular culture, an attitude that distinguishes and colors all of his constitutional scholarship.

I want to talk about constitutional theory's relationship to popular attitudes and popular culture in terms of two opposed positions -- one I shall call populist and the other progressivist.⁽²³⁾ The distinction between populism and progressivism is orthogonal to the more familiar distinction between "left" and "right." An opposition between progressivism and populism exists wholly within left-liberal discourse, just as one exists within the discourse of conservatives; we might say that the two sets of oppositions form a box of four.⁽²⁴⁾ However, for purposes of this essay I want to focus primarily on the discourse of left-liberals, because it is the ideological community in which both Sunstein and I (and a great many other legal academics) are located.⁽²⁵⁾

By "populism" and "progressivism," I mean to invoke the spirit of two successive reform movements in American history, the first primarily agrarian and the second urban.⁽²⁶⁾ Despite their differences, progressivism and populism had many similarities, so much so in fact that the two are easily confused. Many of the reforms advocated by populists in the late nineteenth century -- for example, direct election of senators, the eight-hour day, graduated income taxation, and currency reform -- were put in place by progressives in the early twentieth century, albeit for somewhat different reasons.⁽²⁷⁾ Thus, although I am particularly interested in the ways in which populism and progressivism diverge, the two should not be seen as diametrically opposed. They were and are often uneasy allies, but allies they have been nevertheless. Moreover, when I speak of "populism" and "progressivism" today, I am necessarily extrapolating from events in American history to offer principles that might help us understand trends in contemporary political debates. Cass Sunstein, administrator of the powerful Office of Information and Regulatory Affairs in the White House Office of Management and Budget, will return later this month to his previous post at Harvard Law School, the White House will announce Friday.

Sunstein, a celebrity academic who met Barack Obama when they were both teaching at University of Chicago Law School was among the world’s most-quoted law professors when he came to Washington in 2009. He was named the new president’s chief regulatory enforcer (often called the “regulatory czar”) as head of OIRA, “oh-eye-ruh,” an office that gets little attention but is among an administration’s most potent levers.

Like Obama, Sunstein embraces “behavioral economics” – an emphasis on human behavior, rather than abstract theory, for identifying incentives to promote desired financial and environmental activity by individuals and corporations. The field of study supplied early underpinnings for Obama’s plans for health care and financial regulation.

Sunstein became a lightning rod for liberal activists who had hoped the administration would be more aggressive with regulatory policy. He had met his future wife – Samantha Power, who also works for the White House as the National Security Council’s Senior Director for Multilateral Affairs and Human Rights — while the two were campaigning for Obama in Iowa.

Ostensibly a review of my Federalism: The  Founders’ Design, J.M. Balkin  employs the  bulk  of  forty-three   pages  to launch  his own deconstructionist  theory  of  judicial  adjudication. He  uses me as a whipping boy, as if the  doctrine  that judges construe and do not make law, that  the clearly discernible intention of the draftsmen  is to be given effect sprang full- armed from my brow, when in fact I merely restated 600 years of Anglo-American practice.3 Thomas  Grey,  himself  an  activist, wrote  that   “interpretivism” -the   doctrine  of  original  intention—is a view “of great power and compelling simplicity … deeply rooted in our history and in our shared principles of political legitimacy. It has equally deep roots in our formal constitutional law.”4

One who is committed to an opposing theory is unlikely to write an unbiased review; and from time to time Balkin’s bias discolors his tale. Thus he converts my measured critique of Hamilton’s about-face after 1787 into  “Hamilton  was a scoundrel.”

Yale Law Professor Jack Balkin didn’t win friends when he announced that (1) he is now a constitutional originalist and (2) the original meaning of the Fourteenth Amendment protects the right to abortion.1 His claim to membership in the originalist club brought forth a small army of eager bouncers, who were sure that originalism couldn’t possibly defend the paradigmatic departure from the Constitution’s original meaning.2

Balkin has indeed posed a radical challenge to the vision of law that drives the originalists – more radical than he is willing to admit.  His theory is in such deep tension with a commonly held vision of the rule of law that his argument is, to put the point precisely, disgusting.
