Thoughts Leading to ‘Is child marriage and forced marriage part of Islamist social norms?’

If you are an American, what would you consider too young for a female to marry a male? The age limit for every State in the Union except Nebraska for consensual marriage is 18 years of age. In Nebraska the age of marital consent is 19.

Under the age of 18 (or 19 in Nebraska) marital permission MUST be attained and that attainment can vary from State to State. According to “State-By-State Legal Age Marriage Laws” by Sheri Stritof (updated info as of 10/15/19) on The Spruce website; parental permission is at least required (some State have additional hurdles) for youngsters aged 16 and 17 years old. If a teen gal 15 and younger in some States desires marriage, a Judge has to get involved. And in most of those judicial instances proof of pregnancy or birthing a child is required. Click the embedded link in the title if you want to read State-by-State details.

By now you should be asking yourself, “Why does this Blog Editor care?” OR ask yourself for that matter, “Why should I care about the legalities of underage marriage?” (Unless such circumstance have hit home for you, then better start somewhere exploring your options.)

In my case, underage marital legalities began my pondering after reading a post by Paul Sutliff at his Civilization Jihad blog where he writes about Islamic social norms pertaining to child-marriage. AND when I say “child-marriage” I mean a little child-girl marrying (usually by force or sale or both) an adult MUCH older male.

On March 1, 2020 The News out of Pakistan published an article on child marriage in the country. In the article an 11 year old is basically sold to a man who is 60 years old. The young girl finds herself married and is soon violated and nearly dies from the encounter. The News reminds its readers that Child Marriage is illegal in Pakistan. The News also attests that Child Marriage is indeed a forced marriage in that children are not able to make adult decisions. The News also communicates the sad truth that Child Marriages laws are rarely enforced in Pakistan for a variety of reasons, among them a lack of birth records attesting to a female’s age.

Is there another reason for the lack of enforcement? Is Child Marriage and/or forced marriage an Islamic social norm?

Child marriage is endorsed by Islam because Muhammad married a girl at the age of 6 and consummated the marriage when she was 9. Aisha herself is recorded as having stated she was 9 years old. This is in lunar years not solar years, so Aisha may have still been 8 solar years old. It is one thing to hear that Muhammad had sex with a child bride who was 9 lunar years old, but when you start to look at the evidence for it in the Hadiths you learn that it is Aisha herself who says she was 9 years old.

'A'isha (Allah be pleased with her) reported that Allah's Apostle () married her when she was seven years old, and he was taken to his house as a bride when she was nine, and her dolls were with her; and when he (the Holy Prophet) died she was eighteen years old. (Sahih Muslim Book 16, Hadith 83)

Narrated `Aisha: 
that the Prophet  married her when she was six years old and he consummated his marriage when she was nine years old. Hisham said: I have been informed that `Aisha remained with the Prophet  for nine years (i.e. till his death). (Sahih al-Bukhari 5134)

The fact that dolls were with Aisha tells that us she had not yet entered puberty. In Islamic culture, girls were allowed to play with dolls until they entered puberty. Girls Health.gov states that girls begin puberty between the age of 8 and 12. So it is entirely possible that she had entered puberty. But the fact that she was still playing with dolls calls this into question.

According to Bukhari, Muhammad exhorted his followers to marry young virgin girls as he did. The following hadith has Muhammad talking about playing with them.

Narrated Jabir bin `Abdullah:
When I got married, Allah's Messenger said to me, "What type of lady have you married?" I replied, "I have married a matron' He said, "Why, don't you have a liking for the virgins and for fondling them?" Jabir also said: Allah's Messenger said, "Why didn't you marry a young girl so that you might play with her and she with you?' (Sahih Bukhari Vol. 7, Book 62, Hadith 17)

Keep in mind that devote Muslims require more than the Quran in order to copy what Muhammad did. This imitation aspect of Islam is complete from the exact copying of the movements and words said in prayer to every aspect of his life.

Attempts to outlaw the behavior of marrying prepubescent girls and consummating the marriage have been tried in Islamic countries like Pakistan. In 2016, the country attempted to raise the minimum age for marrying to 16. “A representative from the Council of Islamic Ideology (CII) had dubbed the amendment to the Child Marriage Restraint (Amendment) Bill 2014 as "anti-Islamic" and "blasphemous" during the committee meeting.”

In the Philippines, the marriage age is codified in the Code of Muslim Personal Laws, which was originally written in 1977. A Primer on the Code of Muslim Personal Laws of the Philippines states:

Any Muslim male at least fifteen years of age and any Muslim female of the age of puberty or upwards and not suffering from any impediment under the provisions of this Code may contract marriage. A female is presumed to have attained puberty upon reaching the age of fifteen. (Art. 16.1)

This looks like marriage is something equally agreed to by both the male and female. However, that is not entirely true. It is also not true that a female must have started puberty. The Primer proposes two questions that address this.

CAN A FEMALE BELOW FIFTEEN YEARS OF AGE CONTRACT MARRIAGE?

Yes. The Shari’a District Court may, upon petition of a proper wali, order the solemnization of the marriage of a female who, though less than fifteen but not below twelve years of age, has attained puberty. (Art. 16.2)

IF ANY OF THE CONTRACTING PARTIES IS BELOW THE PRESCRIBED AGE, WHAT HAPPENS TO THE MARRIAGE?

Marriage through a wali by a minor below the prescribed age shall be regarded as betrothal. It may be annulled upon the petition of either party within four years after attaining the age of puberty, provided no voluntary cohabitation has taken place and the wali who contracted the marriage was other than the father or paternal grandfather. (Art. 16.3)

A Wali is a guardian. The male parent/guardian may arrange a marriage of a child bride after she is 12. It is stated that the bride may annul the marriage four years after, provided there has been no cohabitation.

In Reliance of the Traveller, which is shariah in English, we learn that marriage AND consummation of the marriage to prepubescent girls are permissible:

e10.3 When a woman who has been made love to performs the purificatory bath, and the male's sperm afterwards leaves her vagina, then she must repeat the ghusl if two conditions exist:

(a) that she is not a child. but rather old enough to have sexual gratification (A: as it might otherwise be solely her husband’s sperm);

It must be said that Islamists have the only religion that defends child marriage. It is not the only culture to have child marriages. It is only a few years ago that Tennessee outlawed child marriage.

What about other forms of forced marriage? While doing research on this topic, on Google, the terms “forced marriage” and Islam were entered. The most prominent result took me to Discover-the-truth.com, where Kaleef K Karim had written a brief piece alleging that Islam requires consent of both the woman and the man. He began by giving a passage from the Quran 4:19, showing that women are considered property and can be inherited.

O you who have believed, it is not lawful for you to inherit women by compulsion. And do not make difficulties for them in order to take [back] part of what you gave them unless they commit a clear immorality. And live with them in kindness. For if you dislike them - perhaps you dislike a thing and Allah makes therein much good.

But in this sense, women as property must consent to being married. This speaks of women, not child brides. Kaleef considers this strong enough evidence to state: “So the above passage from the Quran is crystal clear that men cannot inherit women against their will. This passage alone is enough evidence that Islam forbids it, but we will go further.” Sadly, Kaleef misses that this passages is specifically talking about inheritance, which basically equates women with property.

The next passage Kaleef offers is indeed troublesome.

Abu Hurairah narrated that:
The Prophet said: "A matron should not be given in marriage until she is consulted, and a virgin should not be given in marriage until her permission is sought, and her silence is her permission." (Jami` at-Tirmidhi 1107)

Equating silence with consent is problematic! What if the bride to be is scared for her life? What if she has been told if she says no, her family will be killed? But in Islam this is OK? Silence equals consent? It becomes twice as problematic when the Islamic marriage ceremony is looked at. Unlike, Judaism and Christianity, in Islam, consent is measured in a contract signed by four witnesses, two for the bride and two for the groom. If the bride is pressured to sign and the witnesses are provided by the groom, a forced marriage can occur easily. Remember here that silence of the bride to be is seen as consent. Kaleef did not address other passages which refer to marrying a slave. Slaves do not get choices.

'If you fear that you shall not be able to deal justly with the orphan girls, then marry (other) women of your choice, two or three or four; but if you fear that you shall not be able to deal justly (with them), then only one, or (the captives) that your right hands possess.  (Sahih Bukhari Vol. 7, Book 62, Hadith 2)

Narrated Abu Burda's father:
Allah's Messenger said, any man who has a slave girl whom he educates properly, teaches good manners, manumits and marries her, will get a double reward  (Sahih Bukhari Vol. 7, Book 62, Hadith 20) 

This allows Muslim men to take a captive woman as a slave and marry her. Of course, she must convert to Islam first. Historically, Islam has forced conversions through threats during conquests.

Muhammad himself presided over a marriage where the woman was given no chance to consent. In fact she offered her consent in marriage to Muhammad not to someone else!

Narrated Sahl bin Sa`d As-Sa`idi:
A woman came to Allah's Messenger () and said, "O Allah's Messenger ()! I have come to give you myself in marriage (without Mahr)." Allah's Messenger () looked at her. He looked at her carefully and fixed his glance on her and then lowered his head. When the lady saw that he did not say anything, she sat down. A man from his companions got up and said, "O Allah's Messenger ()! If you are not in need of her, then marry her to me." The Prophet () said, "Have you got anything to offer?" The man said, "No, by Allah, O Allah's Messenger ()!" The Prophet () said (to him), "Go to your family and see if you have something." The man went and returned, saying, "No, by Allah, I have not found anything." Allah's Apostle said, "(Go again) and look for something, even if it is an iron ring." He went again and returned, saying, "No, by Allah, O Allah's Messenger ()! I could not find even an iron ring, but this is my Izar (waist sheet)." He had no rida. He added, "I give half of it to her." Allah's Messenger () said, "What will she do with your Izar? If you wear it, she will be naked, and if she wears it, you will be naked." So that man sat down for a long while and then got up (to depart). When Allah's Messenger () saw him going, he ordered that he be called back. When he came, the Prophet () said, "How much of the Qur'an do you know?" He said, "I know such Sura and such Sura," counting them. The Prophet () said, "Do you know them by heart?" He replied, "Yes." The Prophet () said, "Go, I marry her to you for that much of the Qur'an which you have.“ (Sahih al Bukhari Vol. 7, Book 62, Hadith 24)

If Muhammad required no consent in a marriage he performed how many Imam’s who are eager to copy him, will require consent? These passages explain some of the forced marriages that are now monthly making the news.

Christian Girl Abducted in Broad Daylight



Christian-Pakistani young woman was kidnapped in Pakistan then forced to convert to Islam followed by a forced marriage. Shamim Mahmood (Masih) submitted this news. Here are some links with similar information but with tidbits of further details if you look at them:

Islamabad (Shamim Masih): It was broad daylight, on Thursday, May 12, 2016; a 24 year-old Christian divorced woman was kidnapped whilst returning home from Excel Education School, an adult learning center in Bihar Colony Kot Lakhpat, Lahore. She joined this institution and started learning only few months back, as Maryam Mushtaq decided to educate herself to help her family out of poverty that she might be able to earn a higher wage. She was undertaking a very basic level Matriculation education (GCSE standard) and was hoping to progress onto further education for an eventual full-time career in teaching.
 
On the sad day, around at 13:30 hours whilst she was walking back to her house with her younger brother Rohail Mushtaq (11 years) and Maryam was fully force grabbed by two Muslim men with their faces covered with masks. The abductors bundled Maryam into the back of a white Toyota Corolla, Licence plate LEA -5393. The men hurled abuse at young Rohail and threatened violence if he intervened and the young man simply froze in fear. However, two men on motorcycles saw the abduction and chased the vehicle but sadly the kidnappers escaped.




Mussarat Mushtaq (53 years), the mother of Maryam reported the abduction to local police at Liaquatabad Police Station and registered a first incident report (FIR). Police initiated an investigation on the license plate of the vehicle and then phoned the owner. After two days on 14th May 2015 Police called Mussarat to the police station explained to the family that Maryam had been married to a 32 year-old Muslim man Muhammad Ali and showed certificates of Maryam's marriage to her.  Cases like this are normally rejected outright however due to a number of witnesses having observed the crime; it seems Police had no option but to register a crime.

Mussarat told that "Three years ago my husband died of cancer, two years ago Maryam's sister died. Now kidnappers have taken away my daughter, I am devastated. Maryam was a good intelligent hard working girl, she went back to college to improve her chances for employment so that she could support her family. The kidnappers have destroyed her future.  Maryam had a good relationship with her brother Rohail and remaining sister Khusboo (23 years), they would know if she had been interested in this man. None of them have ever even seen him before. Maryam like the rest of us attends church every week there is no way she would give up her whole life and salvation to marry a Muslim man. Jesus has always been the centre of her life."

I met the investigating officer Mohammed Razaq, who told him that police were taking this kidnap case very seriously.

"Police are following through on a kidnap and forced marriage charges and are bringing Maryam and Muhammed Ali to the local court in the next few days, for an initial hearing. However, Maryam, has not been removed from the clutches of Muhammed Ali and it is feared she will be coerced into stating she is in a lawful marriage. The fact that she has been found so quickly is advantageous as the pressure applied by the abductors will be minimal; moreover, the daylight abduction yielded a number of material witnesses."

Wilson Chowdhry, Chairman of the BPCA, said: 


"Yet again an innocent Christian girl has been kidnapped and forced into Islamic marriage.  We do not know the depravity or the brutality she has had to face but her entrapment will have a sordid edge to it no doubt. Police have responded relatively quickly, but had to in circumstances of traumatic daylight abduction that was witnessed by many. The abductors are known and yet the girl still has not been returned to the family and it is feared that corrupt police could collude with the kidnappers if bribed significantly.  A justice system that does not permit the release of an abductee to her family is indicative of a flawed and failing rule of law.

May God grant this poor woman freedom and a chance to fulfill her ambition of becoming a teacher, where she might be able to teach love and hope where so much cruelty exists."

Grim Life for Christians in Muslim Pakistan

I have been posting Christian Pakistani Shamim Masih (journalist and Christian Human Rights activist) for years. Shamim paints a grim picture of the persecution of Christians in Pakistan – It is quite brutal. Here is my SlantRight 2.0 Search Shamim Masih link to read just how thorough he has been. I have posted so many reports that there is a good chance the “Search” will not do justice or you will grow weary in reading the evil horrors Muslims (including so-called peaceful Moderate Muslims) have perpetuated against Christians in Pakistan.

Grim Life for Christians in Muslim Pakistan

The U.S. State Department lists only nine nations as “Countries of Particular Concern” (CPC) — a designation for those nations considered to be the worst violators of religious freedom. These include governments that “engage in or tolerate” systematic, ongoing, and unspeakable violations of religious freedom.

According to many human rights activists, this list is far from complete: “the State Department has seemed unwilling to recognize the grave unspeakable abuses of religious freedom in a number of Muslim-dominated countries that the USCIRF [U.S. Commission on International Religious Freedom] considers CPCs: Egypt, Iraq, Pakistan, Syria and Tajikistan.”

Accordingly, on October 21, the USCIRF issued a press release calling on “the State Department to further expand its CPC list to reflect the severe violations occurring in other countries, such as Pakistan, which USCIRF has called the worst situation in the world for religious freedom for countries not currently designated by the U.S. government as CPCs.”

To understand why Pakistan was highlighted, consider the following 10 accounts, all of which took place in the month of October — the same month that the U.S. State Department was being urged to include Pakistan and other countries in its list.

On October 23, a deaf, married Christian woman was gang-raped by three Muslim men who broke into her home while her husband was out working. Despite her screams, no one came to help her. Although one man was arrested, rights activists say he will eventually be released.  According to Sardar Mushtaq Gill, a Pakistani lawyer and human rights activist, “Often in these cases the police take no action or, worse, side with the rapists. Christian families or witnesses are pressured to withdraw complaints.”

On October 15, eight days before the deaf Christian woman was raped, two Muslim men, both named Muhammad, who had earlier raped two teenage Christian sisters at gunpoint, were acquitted in court. Not only did a key witness change his statement after receiving a bribe, but according to the girls’ father, “The lawyer didn’t fight the case very well and with commitment. Mostly, he stayed absent from the hearings of the case during the proceedings. The lawyer didn’t even participate in the cross-questioning with the culprits in the court. … We face serious life threats from the culprits now, as they are being released from jail.”

A report from October 5 cites three separate incidents in which five young Christian girls were abducted and sexually abused: Two were kidnapped and gang-raped by a group of Muslim men; a 13-year-old Christian girl was kidnapped and raped; and two other Christian girls were abducted and abused by a group of human traffickers who forced them into prostitution.

Nabila Bibi, a Christian woman who had been engaged to a Christian man for a year and was preparing to marry him in a few weeks’ time, was abducted, forcibly converted to Islam, and then forcibly married to a Muslim man named Allah Rakha. After discovering her whereabouts, her fiancé went to the kidnapper’s home on October 15 and demanded to see her. Rakha, who had 15-20 other Muslims with him, refused, and warned the Christian that because his fiancée was now Muslim, he must never seek her out again, or else suffer “dire consequences.” The report adds that such Christian abductees “may be subjected to sexual violence, rape, forced prostitution, human trafficking and sale, or other domestic abuse or discarded from home after passing some time.”

On October 23, Sonia Bibi, a 20-year-old Christian woman, was set on fire and almost burned to death after she refused to marry a Muslim ex-boyfriend. According to the woman’s testimony, when she turned down his proposal, Latif Ahmed doused her with petrol and set her alight. Burns covered nearly half of her body.

On October 5, Saddique Azam, a Catholic teacher who was appointed headmaster at a primary school in a small village, was beaten and tortured by a group of three Muslim teachers who resented being under the authority of an “infidel.” The Muslims barged into Azam’s office and ordered him to resign. When he refused, they beat him so severely that he needed to be hospitalized.

According to an October 14 report, rights activists are concerned for the life of Asia Bibi, a Christian mother of five who has been on death row since 2010. A Muslim woman, apparently with a personal vendetta against Bibi, had accused her of speaking blasphemy against the prophet of Islam, Muhammad. “She could be killed by any inmate or even a prison guard, so we have to be careful,” said an official. Bibi was put in solitary confinement, where her health has been steadily deteriorating. “She was vomiting blood last month and having difficulty walking.”

An October 23 report titled, “Christians required only as sweepers,” notes that “Christians make up most of the non-Muslim minority in central Punjab and account for 1.5 per cent of the total population. Their representation in sanitation work, however, is above 80 percent.” After noting that Pakistan was named “Land of the Pure” in reference to its Muslim identity (as opposed to that of its largely Hindu neighbor, India), the report adds, “The attitude of forcing Christians into degrading occupations based on their descent continues and owes its existence to this long-entrenched dichotomy of ‘pure’ and ‘impure.'”

An October 19 report tells of a Christian family — a father, mother, and two daughters — who have been on the run since 2006. Their “crime” was that the woman, formerly a Muslim, converted to Christianity and married a Christian man. This prompted threats and attacks from Muslims, including her family:

“Jobless and desperate, they are unable to meet their own needs, as they continue to be threatened, hounded, and attacked because they want to live a Christian life and raise their children in accordance with Christ’s teachings,” notes the report. Due to the stressful experiences and unsanitary conditions they are forced to hide in, the woman has miscarried their third child. The father was shot in the leg and run over by a motorcycle. Even so, “Attempts to file a case against their tormentors have fallen on deaf police ears.”

On October 7, more than 1,000 Christians gathered in front of the Punjab Assembly to protest an “anti-minority” bill that “denies voting rights to women” and “does not allow religious minorities to elect their own representatives.” Religious minorities argued that an appointed official “cannot do anything” except to “become a puppet in the hand of their party.”

These ten accounts from October alone are a typical sampling of what Christians, who reportedly make up roughly 1% of Pakistan’s population, routinely experience. (Over 96% of Pakistan’s population is Muslim).

Worse, the majority of atrocities, according to human rights activists, never get reported for fear of reprisals. It took five years for the account of a two-year-old toddler, who was savagely raped because her Christian father refused to convert to Islam, to become public. She has undergone five surgeries and still remains disfigured. Her family lives in constant fear and in hiding.

According to human rights activist Sardar Mushtaq Gill, who is involved with many of the above-mentioned cases, “Violence against women and children of religious minorities, the weak and vulnerable, is widespread in Pakistan and is often carried out in silence. These cases and the stories do not come to light and when victims talk about it they are intimidated.”

In light of all this, it is high time for Pakistan to be labeled a “Country of Particular Concern” by the U.S. Department of State. Otherwise, the crucial question persists: Why is it not?

Two more Christian Girls Abducted

Shamim Masih reports on the abduction of two Christian-Pakistani girls by Muslims.

Islamic Supremacism strikes Christian and other minority non-Muslim girls in Pakistan. Mohammed expanded Islam against non-Muslims via the pirating of wealth in raids and kidnapping girls for sex-slavery. Since these immoral and inhumane actions are enshrined in the Quran, these kinds of practices are like the veritable uncreated word of Allah. The methods may have changed a bit in the 21st century from Mohammed’s 7th century but the practice remains.

Two more Christian Girls Abducted

ISLAMABAD:  Forced marriages and forced conversions to Islam is a common practice in Pakistan. I see, if there is not an organization like World Vision in Progress (WVIP) protecting Christian faith, the below mentioned two Christian girls might have gone under the curtain. It’s a story of two districts Rahim Yar Khan (R I Khan) and Dera Ghazi Khan (D G Khan), both districts house banned organizations like Sipha Sahabha and Jeyshe Muhammad (SA HERE).

On March 04, 2014; Komal Yousaf 15 was raped and married forcefully and was converted to Islam. Yousaf and Rubina, parents of the girl, work in a factory. Mohammad Aslam Shah, one of the co-workers, often asked them to convert to Islam but they refused saying that they are happy with Christian faith. He didn’t stop there but on February 24, he went to their house with some of his armed companions and asked them to embrace Islam or be ready to face dire consequence. On the same day, when the parents went to work, he came to their house and kidnapped the young girl Komal Yousaf. The couple [parents] went to the police station for the registration of the First Investigation Report (FIR) against the suspect Mohammad Aslam Shah but police didn’t cooperate. Instead the police claimed that the young girl had been converted to Islam and married to Mohammad Aslam. Providentially, the parents came to WVIP and requested for help in this issue. WVIP immediately went into the court and asked the accused to produce the girl in the court. The girl told the court that she has been forcefully married and was threatened to sign a marriage agreement. She also told the court that she was sexually assaulted during these days.
  
The same case is with the young Sobia, 19 from D G Khan. She used to work with her mother in different houses as maid. One day she went to Adil Zulifqar to work but the owner forcefully married her and shifted to Lahore. WVIP came to know [of Sobia’s situation] through a reliable source that he had sold the girl to a rich family in a different city. The [WVIP] organization is dealing with these two cases to rescue these girls. Farrukh H Saif, chief of WVIP said that Muslims in Pakistan believed that Christian girls are commodities and not human beings. It’s [this Muslim reasoning that makes it] a common practice. Around 2000 Hindus migrated to India and many Christians are seeking refuge status in different countries [due to the Muslim abduction practice].

It is observed that on-going violence against minority women has increased and minorities are seeking a safe haven. Tania, Rebecca, Palwisha, Sonia were abducted earlier and now [the Muslim abduction phenomena] has [become] Sobia and Komal’s turn.
